Optometry Complaint Process
The West Virginia Board of Optometry's Complaint Process and Procedures are governed by W. Va. State Code §30-8-18 and W. Va. State Rule §14-4.
If you have a complaint concerning an Optometrist practicing in West Virginia, please complete and sign the following complaint form and the Authorization for Release of Medical or Sales Records and submit it to the Board of Optometry by email or mail it to our office address. As soon as it is received and processed, you will receive a receipt confirmation email.

Upon receipt of a complaint, the Board will notify the named Optometrist of the complaint and the licensee will have thirty (30) days to respond. Upon receipt of the licensee's response, a copy will be provided to the individual who filed the complaint. If a resolution cannot be met between parties, and the Board finds cause or it appears that a violation of the Optometry Practice Act has occurred that requires direct action, an investigation may be opened to verify facts and gather necessary evidence for the Attorney General's review and possible initiation of legal proceedings.
If the facts surrounding a complaint do not justify legal action by the Board, the complaint may be referred to another agency that has jurisdiction of the matter.
Please note the Board has no statutory authority to set or modify fees charged by licensed Optometrists or compel refunds. Complaints with unresolved fee disputes may be referred to Small Claims Court.
